Terms of use
1. About AutoAds
AutoAds (autoads.uk) is run by [company name], a company registered in England and Wales (number [company number]), whose registered office is at [registered office address]. In these terms, "we" and "us" mean [company name]; "you" means anyone using AutoAds.
AutoAds is a place where motor dealers, trade sellers and private sellers advertise vehicles, and where buyers find them and contact the seller. We are not the seller of any vehicle and we are not a party to any sale. The contract for a vehicle is between the buyer and the seller.
2. Using the site
- You must not misuse AutoAds: no false or misleading adverts, no spam or bulk messages, no attempts to break into accounts or the site, and no copying of listings in bulk.
- We may change, suspend or withdraw any part of the site, and may refuse, edit or remove any advert, at any time.
- Information on the site, including vehicle details from the DVLA and other history records, is given in good faith but may be incomplete or out of date. Always check a vehicle, its V5C logbook and its history yourself before you buy.
3. Buyers
- When you send an enquiry, your name, email, phone number (if you give it) and message go to that seller so they can reply. See our privacy notice.
- Never pay a deposit or send money before you have seen the vehicle and its logbook. We never take payments for vehicles and will never ask you to pay a seller through us.
- Your rights when you buy depend on who you buy from. Buying from a business gives you rights under the Consumer Rights Act 2015; buying privately gives you fewer. We are not responsible for the vehicle, its description, or the seller.
4. Sellers
- You must be at least 18, give us true details, and keep your sign-in details private. You are responsible for everything done with your account and by people you add to your team.
- Each advert must be for a real vehicle you are entitled to sell, at the price shown, with honest details and your own photos. You must say if the vehicle has been an insurance write-off and give its category, and keep the advert up to date. Mark it sold or remove it when it is no longer for sale.
- Dealers and trade sellers must follow the law that applies to selling vehicles to consumers, including the Consumer Rights Act 2015 and the Consumer Protection from Unfair Trading Regulations 2008, and say in the advert that they are a business.
- We may check adverts before or after they go live, ask for evidence, and refuse, suspend or remove adverts or accounts that break these terms. Where we can, we tell you why.
- By posting an advert you give us a licence to show it, its photos and its details on AutoAds, on your dealer website if you have one, and in our marketing of the site, for as long as it is listed and for a reasonable time afterwards.
5. Plans, credit and payments
- Dealer plans are subscriptions, billed weekly or monthly in advance through Stripe until cancelled. Any free trial or offer is shown before you start. You can cancel from Plan and billing; the plan then runs to the end of the period already paid for, and is not refunded for part periods unless the law requires.
- Trade sellers buy credit in advance; each advert uses credit for the listing period shown. Unused credit is not refundable except where the law requires or we close your account without good reason.
- Dealer websites are a separate monthly plan, which you can end in the same way.
- Prices are shown before you pay. We may change prices with at least 30 days' notice; the new price applies from your next billing date after that.
- If a payment fails, Stripe tries again. If it still fails, we may pause your adverts or website until it is paid.
6. Our responsibility to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Otherwise:
- We are not responsible for vehicles, adverts or dealings between buyers and sellers.
- We do not promise that the site will always be available or free from errors.
- For business users, we are not liable for loss of profit, business or goodwill, and our total liability in any 12 months is limited to the fees you paid us in that time.
7. Ending your account
You can close your account at any time by contacting us. We may suspend or close an account that breaks these terms, or that has been inactive for a long time, and will tell you why where we can.
8. Changes and the law
We may update these terms; the date above shows when they last changed, and we will tell sellers by email about important changes. These terms are governed by the law of England and Wales, and the courts of England and Wales may hear any dispute (if you are a consumer in Scotland or Northern Ireland, you may also use your local courts).
